Letter of understanding
The Glastonbury Archive is a section of the Isle of Avalon website, dedicated to archiving and making available larger amounts of special material at no cost to suppliers or users, for research purposes, for public benefit and for reference. This site is dedicated to publishing material on Internet which cannot be easily published in commercial printed form, or which is out of print or is not being published. This purpose of this archive is to keep material publicly available for a long time, in safe hands, for thinkers and creators whose work is valuable to the enrichment of human knowledge, understanding and culture.
This is not a legal contract. It is a statement of understanding under which material is accepted for this website, to eliminate potential misunderstandings and to further trust, clarity and integrity. Palden is not legally liable for material published on these sites unless it is demonstrable that such liability has arisen as a result of intentional, careless and harmful actions on his part. Unless otherwise agreed, copyright control is retained by the author/originator or his/her estate.
The Archive is maintained by Palden Jenkins, a professional editor of books and webmaster of the Isle of Avalon site. The Archive will remain with the Isle of Avalon site longterm under Palden's supervision. If there is a future change of operating policy on the Isle of Avalon site, prompting a change, Palden will maintain the Archive independently or attach it to an appropriate website under his control, personally guaranteeing its continuance for as long as he lives, or unless this agreement is properly changed.
Material is accepted on the basis of its quality, originality and value. Acceptance of material does not imply agreement with all that it says, though it does imply respect for its contents. The Archive and Palden Jenkins hold no liability for such content. Once accepted, material is handled with integrity and care. There is no charge for this service unless otherwise agreed, unless made as a voluntary donation, or unless specific additional expenses are mutually agreed in advance. This work is done in Palden's own time and at his own expense, in love, respect and service.
Palden undertakes to build and maintain pages and sub-sites on the Glastonbury Archive to a high standard, facilitating good presentation and access to material. This often includes provision of the material in printable word-processor zipfiles.
If it is impossible at any time to attend immediately to the requests or concerns of originators, agents or site-visitors, Palden reserves the right to delay action until he has time and opportunity available, or alternatively to charge reasonably for rapid action (usually by advance consultation or notification).
This site is free. Eliminating financial transactions frees up a lot of things such as the need to sell and market the Archive and its contents (though it is well-networked on Internet), and it attracts grateful, good-natured customers and helps in research. If, owing to changed circumstances, modest charges are introduced for access by visitors to selected material on these sites, then the fees arising shall be divided as follows: 50% to the originator/author or his/her agent, 25% to the expense funds of the website and 25% to the proprietor. In such cases, fees shall be settled on a six-monthly or annual basis. A separate agreement shall be drawn up to cover financial matters, should this situation arise. However, any charges will be made on a cost-supporting, not a profit-seeking basis, and there is no intention to introduce them in the foreseeable future.
Conditions
The proprietor undertakes this work and commitment under the following conditions:
1. Material shall be presented in a manageable, uncomplicated and trouble-free manner. It is best presented on PC disk or via the Internet. Pictures may be scanned in reasonable quantity at no charge or for a small charge specified in advance. If written material is presented on pa-per, requiring scanning and copy-editing, the time spent doing so is usually chargeable (at a rate of £5-10 per hour, by advance negotiation).
2. All details and principles by which the material is to be accepted shall be discussed and agreed first. If there are any details in this agreement which the originator/author/agent needs to discuss before acceptance of it, this should be done at an early stage before the work is started, and the agreement can then be amended.
3. The originator or their appointed agent shall undertake to be available to answer queries and to view and approve the work done, unless otherwise agreed. Modifications, additions and other changes may be made after the initial setup period if kept uncomplicated, minimal and good-natured. If extensive changes are required, they are to be discussed first, and a new agreement might need making. If contact is not maintained over time or if the proprietor can-not locate the originator/author/agent, the proprietor reserves the right to make decisions and take reasonable initiatives without consultation. If this continues longterm, the proprietor is not to be held legally responsible for acting or taking initiatives which might conflict with any unstated wishes of the originator/agent. In any questions where contact is lost and difficult questions arise, the proprietor shall prioritise the best overall interests of the material it-self. The originator/agent should undertake to inform him properly of any changes of address or status, of extended periods of unavailability or, as necessary, of questions pertaining to inheritance or estates.
4. Palden undertakes to set up the site in a pleasing manner, consulting when necessary and, on occasion, requesting an opinion. If such feedback is not forthcoming within reasonable time, he shall take initiatives thoughtfully and as best he can. However, in the case where requests or demands are made by the originator/agent which Palden considers to be beyond his brief, unreasonable or technically impossible or inadvisable, he requests understanding and good-natured discussion in this matter. In the event of serious or time-consuming disputes, the material shall be withdrawn from the website forthwith and returned to the originator or his/her agent with no further ado and no liability.
5. The proprietor exercises no proprietary claim to copyright control of the material unless specified by the originator. The material may be moved to another web-site by the originator or his/her agent if necessary or requested. However, in this regard Palden requests respect, restraint and consistency so that his efforts are honoured.
6. Permissions. In the case of requests from members of the public to quote or reproduce material, two options are available: (a). the originator or his/her agent shall give their address (preferably e-mail) on the website, to which permission requests and other enquiries and comments shall be sent, or (b). the proprietor shall, in most cases, grant permissions in simple cases (involving no financial transactions and fees, or significant scale of reproduction), and in cases involving fees or fundamental questions (such as extensive publication in print, or the establishment of mirror-websites), he shall refer the matter to the originator or agent for reasonably rapid response.
7. Copyright. On the Internet, copyright practices are marginally different from print copyright practices. All material is automatically copyright according to British and European Union law, and copyright reservations shall be inserted at appropriate places in the material. Visitors to the website may download and store the material on computer and print it out in single copies without needing permission. Reproduction in bulk e-mails or on web-sites of small amounts of material may be done at no charge and without permission if acknowledgements and contact details are included or if a link to the Glastonbury Archive is inserted close to the material, according to acceptable standards. This pertains if there is no commercial gain and if the material is kept intact. All other forms of reproduction or sale require permission. The originator retains copyright throughout: you have the right to take transgressors to litigation if deemed necessary. However, above and beyond the above terms, the proprietor is not liable for copyright prosecution himself unless it is demonstrable that he has intentionally, gainfully and unreasonably breached copyright standards and agreements. Posting material on Internet is an act of generosity, sharing and trust on the part of the originator, and the proprietor under-takes to do all in his power to maintain high standards of integrity with regards to copyright and related issues.
8. Both Palden Jenkins and the originator/agent of any material posted on the Glastonbury Archive undertake to maintain an encouraging and empowering atmosphere of goodwill and mutual support for the duration of any arrangements made between them.
9. In the event of the proprietor's sudden death or incapacitation, responsibility for the material on the site shall pass jointly and severally to Sheila Martin (the proprietor's executor) and to Barry Hoon (former webmaster of the Isle of Avalon website), with Sig Lonegren as an additional adviser. These individuals hold no legal liability, and undertake to decide on future or out-standing issues in the spirit established by the proprietor. If deemed necessary or advisable, they may close the Archive and do what they can to ensure that the material is passed back to the originator/agent (if they have contact with them) or to another responsible operator who will continue the work in a similar spirit.
10. Other reasonable details may be specified by the originator/agent or the proprietor in advance and by discussion and, if necessary, in writing, to be physically attached to this agreement.
